PRIVACY NOTICE FOR SPORTS PROFESSIONALS

At Statscore we are committed to protecting your personal information and respecting your privacy in accordance with applicable laws.

This Privacy Notice is for Sports professionals and explains who we are, how we collect, share, and use personal information about you, and how you can exercise your privacy rights.

Statscore Sp. z o.o. (hereinafter as “we”, “us”, “our”, “Statscore”) respects your concerns about privacy. This Privacy Notice describes our information practices with regard to the processing of your personal information to manage your newsletter subscription request.  It also describes the types of information we maintain, how we may use the information, how we secure it, with whom we may share it and the choices and rights available to you regarding our use of the information.

This Privacy Notice does not supersede any Privacy Policy applicable to your agreement or other business with Statscore.

2. What does Statscore do?

Statscore is a sports technology company providing sports data headquartered in Poland. Our products and services deliver world leading sporting data of teams and a more engaging broadcast, media, and fan experience. Statscore is an organisation providing global services with an office in Poland.

We are committed to protecting and respecting your privacy.

3. Information we collect

Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymised data). The table below sets out in detail the personal information that we may collect about you, which broadly falls into the following categories:

• This data is obtained by us from third party sources such as contracted data providers, online information service providers and other publicly accessible sources.
• The types of information we collect from third parties include statistical sporting data. We use the information we receive from these third parties to further our legitimate interest in providing services our customers.

The data may include an individual’s initials, full name, nickname(s), date of birth, country and place of birth, club where the individual is currently employed, previous club, team and league information, and in relation to individuals who are or have been players and athletes, other information including gender, weight, height, position(s) played, goal(s) scored, or points scored.

Sports professionals are considered as and not limited to:

• Sports professionals – who take part in individual or teams sports football / hockey / swimming etc
• Coaches / managers and other individuals involved in sports

We may disclose your personal information to the following categories of recipients:

• to our customers in connection with the provision of our services;
• to third party services providers and partners who provide data processing services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our website), or who otherwise process personal information for purposes that are described in this Privacy Policy for Sports Professionals.
• to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
• to a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger, or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Privacy Notice;
• to any other person with your consent to the disclosure.

7. Legal basis for processing personal information (EEA visitors only)

If you are a visitor from the European Economic Area, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

Statscore’s right and ability to process the personal information of Sport professionals is based on one (or all) of the following:

• Legitimate interest – as an organisation primarily dealing the compilation and delivery of sporting statistics Statscore has a legitimate interest in using your personal information; and/or
• Public interest – sport is one of the most popular pastimes on earth and the public has a genuine and legitimate interest in being made aware of the events on the pitch or field. In addition, as sports is played in public either in front of a crowd or television cameras the statistical and general information is available to the public.
• We may share your information with leagues, sports federations, coaching partners, the media, and betting partners in order to enrich and facilitate the improvement of sport. Please also see the ‘Aggregated / anonymised data” section of this Privacy Notice for Sports Professionals.
• Add contractual basis to gather confirmation whether Statscore gather data directly from sports personalities with a contractual agreement in place between sport personality and the sports federations in scope.

8. Aggregated / anonymised data

We may collect, use and share “aggregated data” such as statistical or demographic data for any purpose. This aggregated data could be derived from your personal information but is anonymised and not considered personal information as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage or possession your team has.

9. Special category information

We do not generally seek to collect sensitive data (or “special category data”) but may do so with regard to sporting injuries that may affect your participation in any particular sport and is limited to that. The special categories of personal information are information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, health or sex life, sexual orientation, genetic or biometric information. When we do collect special category personal information (injuries only), we rely on the lawful basis that such processing relating to personal information is manifestly made public via the media.

10. Security

We understand that the security of your personal information is important to all Sport professionals alike. When handling personal information, security is something we take seriously, and we seek to ensure that personal information is adequately and appropriately protected. We use appropriate, technical, and organisational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing personal information. Data is encrypted both in transit and at rest and data access is restricted to authorised roles within the company only. Our data processing/storage standards and access regularly reviewed.

11. Transfers

Your information is securely stored on our servers located in Poland. Although Internet never guarantees 100% safety, Statscore uses our best endeavours and applies the highest standards for your personal data security safety, protecting it with the highest care against unauthorized access and disclosure.

We are a global business. This means that it may be necessary for us to transfer personal information outside of the country in which it was collected, or the jurisdiction of your residence, when transferring it to our service providers and business partners located in other countries. If you are based in the European Economic Area (“EEA”), personal information may be transferred to or accessed from outside the EEA in countries which are not governed by data protection laws equivalent to those in force within the European Union (“EU”).

We may keep and process Personal Data on servers which may be owned or controlled by Lsports data Ltd or processed by third parties on behalf of Lsports data Ltd, including reputable cloud-service providers outside EU in Israel, a country outside the European Economic Area (EEA) recognized by the EU as having adequate Data protection laws.

We have taken appropriate safeguards to require that personal information will remain protected in accordance with this Privacy Notice for Sports Professionals. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between us and other parties (service providers and partners), which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law.

12. How Long We Retain Your Personal Information

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, providing historical statistical sports information). When we have no ongoing legitimate business need to process personal information, we will either delete or anonymise it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store the personal information and isolate it from any further processing until deletion is possible.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

13. Your Rights as a Sports Professional

You have the following data protection rights guaranteed by and the EU General Data Protection Regulation:

• the right to access – you have the right to request Statscore for copies of your personal data. We may charge you a small fee for this service;
  the right to rectification – you have the right to request that Statscore correct any information you believe is inaccurate or incomplete according to you;
• the right to erasure – you have the right to request that Statscore erase your personal data. We will do it if this overrides our business interests and inform you about it once it is done;
• the right to restrict processing – you have the right to request that Statscore restrict the processing of your personal data. We will do it if this overrides our business interests and inform you about it once it is done;
• the right to object to processing – you have the right to object to Statscore’s processing of your personal data;
• the right to data portability – you have the right to request that Statscore transfer the data that we have collected to another organization, or directly to you.
